We provide specialist advice to Property Developers, and Neighbours to Developments (whether these be commercial or domestic) in respect of Legal Rights to Light matters plus Daylight and Sunlight assessments in accordance with the BRE guidance to accompany applications for planning permission.

We can provide risk assessments through to Expert Reports for legal Right to Light matters to assist and guide clients through this litigious and complex area. We are able to provide detailed Daylight and Sunlight assessments which would involve 3D CAD modelling and the use of specialist software. Over 20 years experience producing Expert Witness reports and member of the Royal Institution of Chartered Surveyors (RICS) Expert Witness Accreditation Service.

Buildings can obtain a legal right to light which then allows an owner to take legal action against a development which would cause a specific loss of light through existing windows of affected rooms.
Most commonly, a right to light will be acquired by anyone who has enjoyed uninterrupted light through an opening (without specific consent, openly and without threat, and without interruption) for more than 20 years.

Local Authority Planning Departments are able to request a developer to provide an assessment of Daylight and Sunlight as part of the planning application.
At this stage, it should be noted that the Daylight and Sunlight Tests are integral to the Planning system.
These tests are completely separate from the Legal Right to Light which uses completely different parameters to assess the acceptability of light implications on a neighbouring property.
